A Detroit Lions tailgate party recently became deadly. A man using self-defense shot an aggressor. The bullet went through the aggressor and hit an innocent third party. The incident was caught on video, the prosecutors reviewed it and decided not to file charges because they believed he acted in lawful self-defense.
Would prosecutors in Kansas reach the same decision?
It depends as the prosecutors have complete discretion. However, they could have chosen to file charges for the innocent bystander that was shot. In Kansas, that third party being hit would've been considered a reckless crime, and self-defense is not available for reckless crimes. So, while the man may have been justified in shooting the first person, it was reckless to hit the second, and he could have been on the hook if the prosecutor chose to charge him with some sort of reckless crime in Kansas.

Kansas distinguishes between deadly and non-deadly force. Deadly force is likely to cause death or great bodily harm. Non-deadly force is not likely to cause death or great bodily harm. Non-deadly force includes displaying a weapon.
So, pointing a gun or knife at someone doesn't cross the threshold into deadly force until that force is applied.
You can only use deadly force to protect yourself or another person. You can never use deadly force to defend property.
However, defending yourself or somebody else doesn't automatically mean you get to use deadly force. For you to use deadly force, you have to be defending against deadly force.
If somebody is using non-deadly force against you, you cannot respond with deadly force. That’s called proportionality.
Your response has to be proportional to the amount of force being used. If non-deadly force is being used against you, responding with deadly force would be disproportionate, and it wouldn't be justified under Kansas self-defense law.
